Terms of service

Last updated 20 October 2026

These terms govern how venues use DrinksQR. Please read them before you start a trial or subscribe. They are a contract between SimplySIM Solutions Ltd ("DrinksQR", "we", "us") and the business that signs up ("the venue", "you").

1. About us

DrinksQR is a trading name of SimplySIM Solutions Ltd, a company registered in England and Wales (company number 16302568), registered office 4 Gallowsfield Walk, Market Drayton, England, TF9 3FP. ICO registration ZB960469. Contact: hello@drinksqr.com.

2. A business-to-business service

DrinksQR is for businesses only. By starting a trial or subscribing you confirm that you are acting for a business, trade or profession, not as a consumer, and that you are authorised to accept these terms for the venue. Consumer protection rights that apply only to consumers do not apply to this contract.

3. The service

DrinksQR is a software ordering tool. It lets customers at your venue order from their own phones by scanning a table QR code, shows those orders on a live bar screen, and gives you a back office to manage your menu, tables, staff and reports. The features included are listed on our pricing page. We may improve or change features over time; we will not materially reduce the core service during a paid term without notice.

DrinksQR does not take or process payments. Your customers pay you at the table, using your own card machine or cash, when staff bring the order. If we add paying on the phone later, separate terms will apply to it.

4. Orders are between your customers and you

Every order placed through DrinksQR is a contract between the customer and the venue. DrinksQR is not a party to it, and does not sell, supply, prepare or serve any food or drink. The venue alone is responsible for:

  • its products and prices;
  • fulfilling orders, and any refunds;
  • taking payment;
  • licensing, age checks and Challenge 25 (see section 9);
  • allergen and calorie information and the accuracy of its menu;
  • customer service and complaints;
  • health and safety, and the responsible service of alcohol.

Customers can see on the menu that their order is placed with and fulfilled by your venue, and that DrinksQR provides the ordering software only.

5. Your account, bar PIN and staff

You are responsible for keeping your password, bar PIN and staff PINs confidential, for the people you allow to use the back office and bar screen, and for all activity under your account. Tell us promptly if you think a password or PIN has been compromised.

6. Free trial

New venues can start with a free trial of 14 days on the Standard plan. No card is needed, and nothing is charged during the trial. When the trial ends, you can choose to subscribe or leave the account dormant. We don't delete a dormant account: your menu and settings are kept and the back office stays available, while your venue's ordering pages tell customers that ordering through DrinksQR isn't available and to order at the bar. You can subscribe at any time, or ask us to close the account.

7. Plans and fees

  • There are two plans, priced per venue per month and billed monthly in advance: Standard at £69 (up to 20 tables and one bar screen) and Large at £99 (up to 100 tables, and multiple bar screens or service points). If you need more than 100 tables, contact us for a quote. Your plan is the one confirmed when you subscribe; you can move to Large at any time, and to Standard at your next renewal.
  • The branding add-on (your colours, logo and font on the menu, bar screen and table cards) is optional and costs £20 per venue per month on either plan. Once added, it is billed with your subscription for the rest of the current term.
  • Groups with more than one venue get 10% off the monthly price of each additional venue, while the first venue stays subscribed.
  • Optional menu setup, where we build your menu and print-ready QR cards, is a one-off fee: drinks menu £49, drinks plus snacks and sides £69, full food menu by written quote. Setup fees are payable before work starts and are non-refundable once we have delivered the menu.
  • Prices are as shown on our pricing page and are the full price you pay. SimplySIM Solutions Ltd is not registered for VAT, so no VAT is charged.
  • Prices are fixed for each 12-month term. We may change prices for the next term by giving you at least 30 days' notice by email before your renewal date.

8. Term, renewal and cancellation

  • Subscribing starts a minimum term of 12 months from the start date of your subscription, billed monthly.
  • You can end your subscription by giving us at least 1 month's (30 days') written notice by email before the end of the current 12-month term.
  • Without that notice, the contract renews automatically for a further 12-month term, and the same applies at every renewal.
  • If you cancel part-way through a term, the remaining monthly fees for that term stay payable.
  • We may suspend or end the service if you don't pay, after giving you notice and a reasonable chance to pay, or immediately if you seriously breach these terms. We may also end the service for any reason by giving you 30 days' notice, in which case you pay nothing for the period after it ends.
  • After the contract ends we will delete your venue's account, menu, table and order data within 30 days, unless the law requires us to keep it. Ask us before then if you want a copy.

9. Your responsibilities

  • Keeping your menu, prices, descriptions, allergen information and calorie (kcal) information accurate, complete and up to date. Customers are told to ask staff about allergens; you remain responsible for allergen and calorie information under food law.
  • Complying with the Licensing Act 2003 and your premises licence, including age checks before serving alcohol and any Challenge 25 policy. DrinksQR marks alcoholic items on tickets, but checking ID when delivering, and refusing a sale, is your staff's responsibility.
  • Telling your customers how their order data is used, for example with a privacy notice at the venue or on your website.
  • If you use the optional mailing list: sending marketing emails only to contacts shown as subscribed, using a fresh export for each send; including each person's own unsubscribe link in every marketing email; removing people who unsubscribe promptly, and in any case before your next send; and complying with UK GDPR and the Privacy and Electronic Communications Regulations (PECR). DrinksQR collects the opt-in and stores the list for you, but doesn't send your marketing emails, so the content and sending of those emails are your responsibility.
  • Placing table QR codes only at the tables they belong to.
  • Complying with all other laws that apply to your venue and your business.

10. Acceptable use

You must not: use DrinksQR for anything unlawful, harmful or misleading; upload content you have no right to use, or that is offensive; try to break, overload, probe or reverse-engineer the service; access other venues' data; share accounts outside your business; or resell the service without our written permission. We may suspend access if we reasonably believe you are breaking this section.

11. Data protection

For customer order data, staff profiles and your mailing list, you are the controller and we are your processor. Our data processing terms (the information required by Article 28 UK GDPR) are set out in our data processing addendum, which forms part of these terms. Each party will comply with UK GDPR and the Data Protection Act 2018. Our privacy policy explains how we handle data as a controller.

12. Intellectual property

We own DrinksQR, its software and its design. You own your menu content, logos and brand assets, and you give us permission to use them only to provide the service to you.

13. Availability and no warranties

We aim to keep DrinksQR available and to plan maintenance outside busy service hours, but we do not guarantee that it will be uninterrupted, timely or error-free. Internet access at your venue and on customers' phones is outside our control.

The service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and terms that would otherwise be implied by statute, common law or custom, including as to satisfactory quality and fitness for a particular purpose.

14. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under English law.

Subject to that:

  • we are not liable, whether in contract, tort (including negligence) or otherwise, for any loss of profits, revenue, business, goodwill or data, or for any indirect or consequential loss;
  • we are not liable for missed, delayed or incorrect orders, for downtime or interruptions to the service, or for anything a customer does at your venue;
  • our total liability arising out of or in connection with these terms is limited to the lower of £100 and the total fees you paid us in the 12 months before the event giving rise to the claim. No fees are paid during a free trial, so during a trial this limit is £0.

15. Your indemnity

You will indemnify SimplySIM Solutions Ltd (trading as DrinksQR) against all claims, losses, costs and expenses (including reasonable legal fees) arising from claims by customers or other third parties that relate to your products, your service, your sale of alcohol or your menu information, including allergen and calorie information.

16. Use outside the United Kingdom

DrinksQR is intended for venues in the United Kingdom. We make no representation that the service is lawful or suitable for use anywhere else. If you use it outside the UK, you do so at your own risk, you are responsible for complying with local laws there (including licensing, tax and data protection), and you will indemnify us against anything arising from that use.

17. Changes to these terms

We may update these terms. We will give you at least 30 days' notice of changes by email; if you don't agree, you can cancel before they take effect.

18. General

  • Entire agreement. These terms, the data processing addendum and the plan you choose are the whole agreement between us about DrinksQR, and replace anything discussed before.
  • No reliance. You confirm that you have not relied on any statement, promise or representation that is not set out in these terms.
  • Severability. If any part of these terms is found to be invalid or unenforceable, the rest stays in force.
  • No waiver. If we don't enforce a right straight away, we can still enforce it later.
  • Assignment. We may transfer our rights and obligations under these terms to another business. You may not transfer yours without our written consent.
  • Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as power or internet failures, failures of our hosting provider, cyber attacks, or industrial action.
  • Notices. We will send notices to the email address on your account. You can send notices to us at hello@drinksqr.com.
  • Third-party rights. Nobody other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999. This includes your customers.

19. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales, wherever your venue is based. The courts of England and Wales have exclusive jurisdiction, except that we may bring proceedings for unpaid fees in any country where you are based or have assets.

If these terms are translated, the English version prevails.
